1. Terms of Service

1.1 Agreement

By creating an account or using Rekindle ("the Service"), you agree to these terms. If you are using the Service on behalf of a business, you confirm that you have the authority to bind that business to these terms. If you do not agree, please do not use the Service.

1.2 What Rekindle does

Rekindle is a customer re-engagement platform for small businesses. It allows you to upload customer data, score customers based on engagement, generate AI-drafted messages, and send emails to your customers. The Service is provided on a subscription basis with free and paid tiers.

1.3 Eligibility

You must be at least 18 years old and legally capable of entering into a binding agreement. The Service is intended for business use — you must have a legitimate business relationship with the customers whose data you upload.

1.4 Your account

You are responsible for maintaining the security of your account credentials. You must not share your login details with others. You are responsible for all activity that occurs under your account. Please notify us immediately if you suspect unauthorised access.

1.5 Subscription tiers

Rekindle offers three tiers: Free, Growth, and Scale. Each tier has specific limits on the number of customers and AI-generated messages per month. Exceeding your tier's limits will require an upgrade. Features and pricing for each tier are listed on our pricing page and may change with notice.

1.6 Payments and billing

Paid subscriptions are billed monthly in advance through our payment partner, who acts as the merchant of record for all transactions. By subscribing to a paid tier, you authorise recurring monthly charges. Prices are displayed in your local currency where available. All fees are inclusive of applicable taxes, which are calculated and collected by our payment partner on our behalf.

1.7 Cancellation

You may cancel your subscription at any time. Upon cancellation, you retain access to your paid tier until the end of your current billing period. After that, your account will revert to the Free tier. Your data will remain accessible unless you choose to delete your account.

1.8 Service availability

We aim to keep Rekindle available at all times but cannot guarantee uninterrupted access. The Service may be temporarily unavailable due to maintenance, updates, or circumstances beyond our control. We will make reasonable efforts to notify you of planned downtime in advance.

2. Privacy Policy

2.1 What we collect

When you use Rekindle, we collect the following information:

We do not sell, rent, or share your data with third parties for their marketing purposes. We do not use your customer data to train AI models.

2.3 How we store your data

Your data is stored securely using industry-standard cloud infrastructure with encryption at rest and in transit. Each business's data is fully isolated — no other user or business can access your records. We use row-level security policies to ensure strict data separation at the database level.

Rekindle uses the following third-party services to operate:

Each provider is selected for its security standards and compliance. We only share the minimum data required for each service to function.

2.5 Cookies

Rekindle uses essential cookies only — specifically for authentication (keeping you logged in). We do not use advertising cookies, tracking pixels, or analytics cookies from third parties.

2.6 Your rights

Depending on your location, you may have the right to:

2.7 Data retention

We retain your data for as long as your account is active. If you delete your account, all data (customers, messages, upload history, and your business profile) is permanently and irreversibly erased from our systems. We do not keep backups of deleted accounts.

2.8 POPIA compliance (South Africa)

Rekindle is operated from South Africa and complies with the Protection of Personal Information Act (POPIA). We process personal information lawfully, for a specific purpose, and with appropriate security measures. You may lodge a complaint with the Information Regulator if you believe your rights have been infringed.

2.9 GDPR compliance (European Union)

If you are located in the European Economic Area, you have additional rights under the General Data Protection Regulation (GDPR). Rekindle acts as a data processor on your behalf — you remain the data controller of your customer data. We process data based on our contractual obligation to provide the Service. You may exercise your GDPR rights by contacting us at the address below.

3. Refund Policy

3.1 Free tier

The Free tier is provided at no charge. No refund applies.

3.2 Paid subscriptions

If you are unsatisfied with Rekindle, you may request a full refund within 14 days of your initial purchase or any renewal. Refund requests after 14 days will be considered on a case-by-case basis but are not guaranteed.

3.3 How to request a refund

Contact us at hello@rekindle.business with your account email and the reason for your request. Refunds are processed through our payment partner and typically appear on your statement within 5–10 business days.

3.4 Cancellations

Cancelling your subscription is not the same as requesting a refund. When you cancel, you retain access until the end of your billing period. If you want both a cancellation and a refund for the current period, please contact us.

3.5 Exceptions

Refunds will not be issued if your account was suspended or terminated due to a violation of these terms or our acceptable use policy.

4. Acceptable Use

You agree to use Rekindle responsibly and lawfully. Specifically, you must not:

We reserve the right to suspend or terminate accounts that violate this policy, with or without notice. If we become aware of illegal activity, we may report it to the relevant authorities.

5. Data Ownership & Portability

5.1 Your data belongs to you

You retain full ownership of all customer data you upload to Rekindle. We do not claim any intellectual property rights over your data. We do not use your data to benefit other customers, train models, or for any purpose other than providing the Service to you.

5.2 Data export

You can download all your customer data at any time in spreadsheet format from the Settings page. This right is available on all tiers, including Free.

5.3 Account deletion

You can permanently delete your account and all associated data from the Settings page. This action is irreversible — all customers, messages, upload history, usage records, and your business profile will be permanently erased. We recommend exporting your data before deleting your account.

5.4 No lock-in

There are no long-term contracts. You can export your data and leave at any time. Your data is provided in standard formats that can be used with any other tool.

6. AI-Generated Content

6.1 How AI is used

Rekindle uses artificial intelligence to draft personalised email messages for your customers. The AI generates suggested text based on the customer context you provide (such as their name, purchase history, and engagement status). Customer data is sent to our AI provider only for the purpose of generating the message and is not stored or used for training by the AI provider.

6.2 Your responsibility

AI-generated messages are drafts. You are responsible for reviewing, editing, and approving every message before it is sent. No message is sent automatically — you must explicitly choose to send each one. You are solely responsible for the content of any message you choose to send to your customers.

6.3 No guarantees

AI-generated content may occasionally be inaccurate, inappropriate, or not suited to your needs. We do not guarantee the quality, accuracy, or effectiveness of any AI-generated message. Always review messages before sending.

7. Limitation of Liability

Rekindle is provided "as is" and "as available" without warranties of any kind, whether express or implied. To the fullest extent permitted by law:

Nothing in these terms excludes or limits liability for fraud, gross negligence, or any liability that cannot be excluded by law.

8. Changes to These Terms

We may update these terms from time to time. If we make significant changes, we will notify you by email or through a notice in the Service at least 14 days before the changes take effect. Your continued use of the Service after the effective date constitutes acceptance of the updated terms. If you disagree with the changes, you may cancel your subscription and delete your account before the effective date.
